Tort law, commonly perceived as gender-neutral, harbors deep-rooted gender inequalities. The harm principle, central to tort law, frequently falls short in recognizing diverse civil wrongs, particularly those experienced by women when they don't align with the traditional male perspective of harm. Delving into areas such as privacy, sexual autonomy, and harassment, this essay explores the law's shortcomings and proposes expanding the concept of harm to encompass emotional, psychic, and moral dimensions. Currently, case law undervalues these aspects, hindering victims' ability to seek due compensation. By broadening the understanding of harm, tort law can more effectively address the full scope of civil wrongs, ensuring justice for all individuals, irrespective of gender."
