In October 2024, European Law Open published Matteo Bonelli and Mateus Correia de Carvalho’s article "No need to look, trust me! Mutual trust and distrust in the European arrest warrant system". The paper explores the tensions between mutual trust and fundamental rights protection in the EAW, by contextualising mutual trust in different areas of EU law. After having analysed the different levels of lawful distrust accepted by the CJEU, the authors propose a bidimensional account of mutual trust as a legal principle that accommodates both trust and distrust as tools for managing the uncertainty and dynamic nature of trust-based cooperation.
