De Abraham de Pinto-competitie is een zuster van de Brown-Mosten International Client Consultation Competition voor het Nederlandse taalgebied. Informatie over deze competitie, waaronder ook opnames van de Engelstalige competitie, zijn te vinden op www.brownmosten.com.

Omdat die competitie alleen toegankelijk is voor studenten die de Engelse taal en het bijbehorende juridische jargon goed beheersen, ontstond het idee om voor het Nederlandse taalgebied een zustercompetitie te starten.

De competitie is genoemd naar de 19de-eeuwse advocaat Abraham de Pinto (1811-1878). De Pinto combineerde een fabelachtige kennis van het geldende recht  ‒ hij schreef een artikelgewijs commentaar op alle wetboeken die in 1838 in werking traden ‒ met een vol overtuiging op de bres springen, met name als hoofdredacteur van het Weekblad van het Regt, voor het belang van de advocaat-cliëntrelatie, de vrijheid van meningsuiting en andere grondrechten.

De competitie staat open voor teams van twee studenten die zijn verbonden aan een Nederlandstalige/Afrikaanstalige universitaire opleiding in de rechtsgeleerdheid of rechtswetenschap. Dat betekent dat meegedaan kan worden door teams van Belgische, Antilliaanse, Surinaamse, Zuidafrikaanse en Nederlandse rechtenfaculteiten.

De prestaties van de teams worden beoordeeld door een jury die bestaat uit twee juristen (een rechter en een advocaat) en een (ervarings)deskundige op het gebied van cliëntgesprekken (zoals een arts, psychotherapeut, psycholoog of maatschappelijk werker).

Daarbij wordt gelet op de manier waarop het gesprek wordt gevoerd, het contact met de cliënt, de effectiviteit van het interview, de creativiteit van het advies en de juridische haalbaarheid daarvan. De juryleden gebruiken daarvoor een schema met elf uitgewerkte criteria.

Het grootste deel van hun tijd zijn advocaten kwijt aan het verzamelen en beoordelen van feiten om op basis daarvan hun cliënten te helpen de juiste besluiten te nemen. Voor het voeren van een efficiënt cliëntgesprek moeten advocaten en andere juridische adviseurs in staat zijn om hun cliënt niet alleen te zien en waarderen als een juridisch probleem, maar als een persoon met een juridisch probleem.

Daarom moeten zij:
een goede en professionele werkrelatie met hun cliënt kunnen opbouwen
begrijpen hoe hun cliënten hun problemen zelf zien
in staat zijn om de beschikbare opties te onderzoeken en daarvan de consequenties te onderkennen
strategieën kunnen vinden waarmee hun cliënten hun problemen kunnen oplossen
ethische en morele problemen kunnen opmerken en er een oplossing voor zoeken

On Sunday 22 May, Sina Oehler sadly passed away. Sina had just returned home to her parents in Germany after a period of fieldwork in Ghana, which she conducted as part of the MA Globalisation & Development Studies. Sina was a young woman who travelled the world without limiting herself. She seized every opportunity to make new discoveries, going as far as Latin America, Africa and Australia. Her eagerness to learn took her to the Gambia during her undergraduate degree, which sparked her interest in Africa and issues surrounding globalisation and development. She also embraced new experiences through her studies in Germany, the UK and the Netherlands. Even in Maastricht this curiosity stimulated her fellow students to discover hidden corners, such as the Livin’ Room Café.

Being a strong-minded and smart student, she successfully submitted a research proposal to undertake fieldwork in Ghana as part of her MA degree. Her research included three months interviewing rural Ghanaian women in order to critically examine how technology affects rural women’s perception of pregnancy and birth. Her supervisor, Bernike Pasveer, was impressed by her achievements in the field, stating that she was pleasant to work with, and a fast and eager learner - her thesis might very well have been good enough for a thesis award, as well as being very relevant for academia and society as a whole. 

Both students and staff thought her a joy in class. Whilst modest and sometimes a bit quiet, when she took the floor she always had something really meaningful to say. Her humour and irony were special as well as the sparkle in her eyes and her generous smile. Sina was always willing to offer her help and support to friends and fellow students. She talked very fondly of her family whom she visited on a regular basis, despite the distance. A keen horse rider and outdoors person, she was fond of animals, especially her mischievous dogs and her horse, Alf.

We will miss her passionate drive and her love for life. Her loss will be deeply felt throughout the GDS programme. Sina will be remembered this year and for the years to come.

The FHML Honours Programme is an extracurricular activity offered to a maximum of 75 talented and motivated FHML students, plus students from the University of Midwifery Education & Studies (AVMU).

The programme is offered in the second and third year of the bachelor’s programmes. It takes 420 hours over a period of 18 months in addition to your regular studies.

Real life (research) project

Along with six to eight other students, you will work under the supervision of an FHML staff member on a project that involves healthcare.

Some examples of projects are:

The Intellectual Property Law School

Monday 21 to Friday 25 November 2016, Macau Cultural Center

The IP Law School is a unique initiative in Asia offering a taught programme in international Intellectual Property Law and its relevance for global, European and Asian economic development and innovation policy.

The IP Law School is extremely suited for trainee lawyers, Intellectual Property professionals with an economic or policy background, and master students in Intellectual Property wishing to enhance their skills at post-academic level.

Starting from the basics of the Paris and Berne conventions, the course covers the development of Intellectual Property Law all the way to the WTO TRIPS Agreement and the WIPO Copyright treaties. Attention is also devoted to regional arrangements, such as the European Patent Convention, and other new international and national initiatives. From a policy perspective free trade agreements and bilateral investment arrangements covering Intellectual Property, as well as ongoing negotiations in the area of protection of traditional knowledge will be covered.

Classes are offered in an intensive Socratic format in the course of one week by experts in the field. 

This challenging programme also expects participants to jointly prepare and argue several moot cases in a friendly, yet competitive atmosphere, providing a unique insight in the way in which colleagues from various jurisdictions approach international and domestic legal problems.

IP as Property - Of Pharmaceuticals, Tobacco, Commodities and Other Matters

The two-days Annual Intellectual Property Seminar offers a forum for IP professionals wishing to be part of a thought-provoking discussion on cutting-edge developments in intellectual property law and policy. Distinguished practitioners, judges and academics from all over the world have contributed to this event. The papers they have presented have been published in book form by Kluwer Law International and Hart Publishing.

The 2016 event will cover the way in which intellectual titles function as property. Not content with approaching intellectual property as a title conferring a 'negative right' to exclude others, right holders have increasingly argued that the right to property entitles them to a 'positive' right that protects their investment against expropriation or other measures that negatively affect their 'legitimate expectations'. The seminar thus looks at the way in which regulatory and policy freedom of a state is curtailed by intellectual property rights, but also how intellectual property can be valued, act as collateral for the purpose of investment and IP exchanges.

The Professional IP Update 2016

The annual professional update provides an overview of all relevant cases and legislative developments of the past year from all over the world. During one day you will be brought up to speed on the major important legal decisions and developments in intellectual property law and policy.
