Jean Monnet Lecture Series:
This freely accessible, hybrid, 3-year Jean Monnet lecture series (2024-2026) will feature scholars working on (areas connected with) migration law and governance from interdisciplinary and/or critical perspectives, as well as relevant policy-makers, civil society, and societal actors.
A number of lectures and debates provide insights to current legal and policy developments at EU level, such as the New Pact on Migration and Asylum. The series also features contributions on the interaction of EU migration law with international refugee, migration, statelessness, and human rights law. Finally, other talks provide novel conceptual insights to the study of migration, such as decolonial or interdisciplinary approaches.
The lecture series is convened by Dr. Lilian Tsourdi as part of the Jean Monnet Chair on EU Migration Law and Governance she holds at the Faculty of Law. The series is organised in cooperation with the research centers and groups MCEL, MACIMIDE and Glaw-NET.

Lecture title: Constitutional Perspectives on Mobility in and to Europe: The role of Art. 2 TEU in interpreting the Area of Freedom, Security and Justice
Abstract: The once intergovernmental Area of Freedom, Security and Justice (AFSJ) has today become a key area for the EU to pursue and achieve genuine public interest goals. This makes the AFSJ a new site of constitutional conflict about sovereignty and identity in the EU and of the EU. Issues of intra-EU mobility and migration to the EU are at the heart of many of these conflicts. Conflicts between freedom and security have increasingly shifted to the EU’s external borders, where human rights are contested. At the same time, intra-EU mobility faces new challenges, and the digitalization of border controls creates new challenges to the fundamental rights of EU citizens. While solidarity is considered a key feature of the European society (Art. 2 TEU), conflicts about solidarity in creating and sustaining the AFSJ abound. In my presentation, I will explain that these conflicts are best understood as conflicts about a European common good. I will then sketch out how interpreting the Treaties in light of the values enshrined in Art. 2 TEU may help to channel the new constitutional conflicts. Finally, I will explore the implications and limitations of such an approach for third-country nationals in the EU and, in particular, for the issue of legal migration.
This session will be chaired and moderated by Prof. Pauline Melin, Assistant Professor at the Law Faculty of Maastricht University (Law Faculty, Maastricht University).
