Two new publications in the Climate Law journal

MCEL member prof. Marjan Peeters has published two new articles in Climate Law vol. 6, 2016. The first, titled “An EU Law Perspective on the Paris Agreement: Will the EU Consider Strengthening its Mitigation Effort?” discusses whether the Paris Agreement will lead to a reconsideration – with possibly a strengthening - of the EU’s efforts regarding greenhouse gas emissions, compared to the earlier UNFCCC commitments. The second article, written in collaboration with Huizhen Chen and Zhiping Li, is called “Contrasting Emission Trading in the EU and China: An Exploration of the Role of the Courts”. While China and the EU both focus on emission trading to reduce greenhouse gas emissions, their political and legal systems differ greatly. For example, in the EU, affected companies can take their case to court, whereas in China it is still an open question whether this is possible. The article explores how these differences affect the functioning of the instrument in the two jurisdictions.
