Joyce and Sarah analysed the CJEU's Kočner v Europol case on EU liability and shared conduct. The case note studies the liability regime through five dimensions (definitional, constitutional, remedy, actor and rights) and argues that while the case constitutes a notable development in the debate on joint and shared responsibility, many questions remain unanswered.
