Constitutionalism and Populism: a book discussion

In the last decade, populist leaders and parties have been increasingly successful around the world. In some cases, these movements have even been able to gain public power. This presents a challenge for constitutionalism and constitutional law. For some, populism is by definition irreconcilable with constitutionalism. At the same time, populist in powers have often used or borrowed constitutional law concepts and more generally rely on constitutional theory to justify their actions. What is exactly the relationship between constitutionalism and populism? Is populism always a threat to constitutionalism? How to understand the new wave of populism, and how can constitutions react to populism?

These and other fundamental questions are tackled in the two recent books: Power to the People – Constitutionalism in the Age of Populism, by Mark Tushnet (Harvard Law School) and Bojan Bugaric (University of Sheffield); and Filtering Populist Claims to Fight Populism The Italian Case in a Comparative Perspective, by Giuseppe Martinico (Scuola Universitaria Superiore Sant’Anna, Pisa).

The Globalisation and Law Network (GlawNet) and the Montesquieu Institute of Maastricht University have invited the three authors to present and discuss the two volumes in an online event on June 14, 2022. The discussion will be led by UM colleagues Monica Claes, Andre Nunes Chaib and Franco Peirone.

Programma

After a brief introduction by Matteo Bonelli and Mariolina Eliantonio, the authors of two volumes (Mark Tushnet and Bojan Bugaric; Giuseppe Martinico) will present their books. A discussion will follow led by Monica Claes, Andre Nunes Chaib and Franco Peirone. The audience will also have the chance the ask questions and interact with the presenters.
