European Human Rights
Full course description
The aim of this course is to study the protection of human rights in Europe under the Council of Europe system, in particular the European Convention on Human Rights (ECHR), as well as its relationship with the European Union. In this context, special attention will be paid to the jurisprudence of the European Court of Human Rights (ECtHR). The content of various rights will be studied such as the right to life, the prohibition of torture, freedom of religion, freedom of expression, as well as some general concepts and doctrines like positive obligations and margin of appreciation.
Course objectives
At the end of the course students are able to:
- Understand the main aspects of the ECHR legal system
- Analyse the case law of the European Court of Human Rights
- Apply ECHR law to hypothetical cases
- Compare the case law of the ECtHR with the case law of the CJEU
Prerequisites
Basic knowledge of international law and constitutional law
