Decisions regarding examinations and study progressm
Students who disagree with decisions taken by the examination committee or an examiner of their faculty, decisions regarding access to or assessments of examinations or tests, decisions relating to colloquium doctum, or the calculation of the total number of credits in connection with the study progress standard, may lodge an appeal. Your appeal has to be sent to the Complaints Service Point. They will send your appeal to the Board of Appeal for Examinations (CBE). Also against a decision on admission for a master you can lodge an appeal.
An appeal may also be lodged in the case of refusal to take a decision. In this case, you also have to submit your appeal to the Complaints Service Point. Refusal to take a decision is the case if no decision has been taken within the statutory term or if no term is available. The authority of the CBE and the grounds on the basis of which an appeal can be lodged are described in Chapter 8 of the Student Charter.
Procedures CSP and CBE
The appeal must be made in writing, in principle within 6 weeks after communication of the decision. The appeal has to be submitted at the Complaints Service Point (CSP).
The CSP will send a confirmation upon the arrival of the appeal. They will also forward your appeal directly to the CBE. The CBE will treat the appeal concerning content.
Before the case is dealt with by the CBE, there will be a settlement meeting between the student and (in most cases) the Examination Committee, in which the complainant and the responsible institute review the possibilities of finding a solution.
If a settlement is reached, the appeal is considered to have been dealt with, and the applicant will be asked to withdraw the appeal. If no settlement can be reached, the Examination Committee will submit a written defence to the CBE and the case will be dealt with in a public session. The CBE's decision will be communicated in writing.
Appeals against the decision of the CBE can be made with the Appeals Tribunal for Higher Education, by submitting a written appeal within 6 weeks after the decision by the CBE. For this procedure, court fees are due. If the Appeals Tribunal grant the appeal, the court fees will be reimbursed by the university.
