Private Law

The research program of the department of private law covers the following five areas:

1. Contract law and the law of obligations in general
Coördinator: Dr. Nicole Kornet

Research in this area focuses on (i) issues relating to the harmonisation and unification of law, and the associated difficulties and obstacles, including the influence of European and international instruments on the contract law and the law of obligations in general of individual member states, and (ii) comparative law research into various aspects of contract law and the law of obligations in general, for example, contract formation, content and effect of contracts, (non)-performance and remedies.


2. Europees, personen- familie- en erfrecht
Coördinator: Prof. mr. G.R. de Groot

Kern vormt de bevordering van convergentie van het familierecht binnen de EU-lidstaten door het ontwikkelen en formuleren van Europese normen. Het rechtsvergelijkend onderzoek aan de hand van verdragsnormen concentreert zich onder meer op vermogenrechtelijke aspecten van samenlevingsvormen, de rechten en bescherming van minderjarigen, de positie van erfgenamen, het personeel statuut en de invloed van Europese normen op het familierecht. De onderzoeksgroep heeft speciale belangstelling voor het familierechtelijke IPR, de rechtspraak van het EHRM en het EHvJ, voor het nationaliteitsrecht en voor de gevolgen van de aanwezigheid van grote groepen moslims in West Europa.


3. Goederenrecht
Coördinator: Prof. mr. J.H.M. van Erp

Comparative and European property law research focuses on three themes: (1) research concerning possible common elements and principles of property law systems, (2) comparative analysis of substantive property law and (3) research concerning the influence of European law on national property law and the development of a common property law of Europe.


4. Liability and insurance
Coördinators: Prof. dr. M.G. Faure and Prof. mr. T. Hartlief

Research in this particular field aims at exposing the foundations of liability and insurance. It is structured into fundamental positive law research on the one hand, and comparative legal as well as interdisciplinary research on the other. Central questions concern for example the function that liability and insurance may have in preventing and compensating damage and the extent to which liability law may affect the insurability of certain risks.


5. Legal persons in Europe
Coördinator: Prof. mr. C.A. Schwarz

The research programme currently is divided in four main lines of research, which are: formal and material harmonization of corporate law, corporate governance and corporate social responsibility. Further specialization is taking place in the Institute for Corporate Law, Governance and Innovation Policies (ICGI).
